Terms of use

1. Scope

These terms apply to the use of the “Comiks” app on iOS, Android and in the browser (“Comiks”), operated by the provider named in the imprint. By creating an account you accept these terms. If you do not agree with them, please do not use Comiks.

2. Your account

You are responsible for everything that happens with your account. Keep your password to yourself and tell us at contact@comiks.app if you suspect someone else is using it. You can close your account at any time in the app's settings.

3. No tolerance for objectionable content or abusive users

Comiks is made for having fun together. There is no tolerance for objectionable content or abusive behaviour. You must not create, upload or share anything that

is pornographic, sexually explicit or sexualises minors,
glorifies or incites violence, terrorism or self-harm,
is hateful, discriminatory, harassing, threatening or bullying towards people or groups,
shows other people without their consent or reveals their private data,
infringes the copyright or other rights of third parties,
is otherwise illegal, or is spam or advertising.

You are responsible for the photos, drawings and texts you add to a comik.

4. Reporting and blocking

Every comik and every user can be reported in the app. Reports reach us immediately and are reviewed within 24 hours. If content breaks these terms, we remove it and ban the account that posted it. You can also reach us at contact@comiks.app at any time.

You can remove a connection at any time. This also blocks the person: you no longer see each other, the comiks you made together are hidden, and they can neither send you a new request nor start a comik with you. You can lift a block in the app's settings.

5. Rights to your content

Your content stays yours. So that Comiks works, you grant us the non-exclusive, free right to store, process and show your content to the people you share it with. If you or your partner publish a comik to the community highlights, it is shown to every signed-in user. The right ends when the content is deleted.

6. Consequences of violations

We may remove content that breaks these terms without prior notice, and suspend or permanently close the accounts responsible. Illegal content may be reported to the authorities.

7. Availability and liability

Comiks is free of charge. We try to keep it available, but cannot guarantee uninterrupted operation. We are liable without limitation for intent and gross negligence; otherwise liability is excluded as far as the law permits.

8. Changes

We may change these terms if there is a good reason, for example new features or changed laws. We will tell you about material changes in the app.

9. Contact and applicable law

Questions, reports and complaints: contact@comiks.app. Austrian law applies, excluding its conflict-of-law rules; mandatory consumer protection rules of your country of residence remain unaffected.
